Terms of Use
Please read these Terms of Use ("Terms") before using ЗНО арена (the "App"), an iPhone and iPad application developed and operated by Vadim Katenin ("I", "me"); the name is Ukrainian for "ZNO Arena". By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You confirm that you are at least 13 years old, and that you are not barred from using the App under the laws of your jurisdiction or Apple's App Store terms.
2. License
I grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, in accordance with these Terms and with the App Store Terms of Service. You may not:
- Copy, modify, or distribute the App, its question banks, or any part of it.
- Extract the question banks in bulk, or republish them in another app, website, or printed material.
- Reverse engineer, decompile, or disassemble the App, except where such restriction is prohibited by applicable law.
- Circumvent the advertising or the reward mechanism.
- Use the App for any unlawful purpose or in violation of any applicable law.
3. What the App is — and is not
The App is an independent study aid. It is not affiliated with, endorsed by, or connected to the Ukrainian Center for Educational Quality Assessment (Український центр оцінювання якості освіти), the Ministry of Education and Science of Ukraine, or any other examination authority. "ЗНО" (External Independent Evaluation) is the name of Ukraine's school-leaving examination, and is used here descriptively, to say which examinations the practice material is aimed at.
The questions are practice material written and compiled for revision. They are not the official examination papers, and no score you achieve in the App is an official result or a prediction of one. I make an effort to keep the questions and answers correct, but I do not guarantee that every question is free of error or that the material matches the syllabus in force when you sit the exam. Corrections are welcome at the address in section 11.
4. Advertising
The App is free and is funded by advertising supplied by Google AdMob, including banner, full-screen (interstitial), and rewarded-video ads. What data the ads involve is set out in the Privacy Policy.
I do not choose, endorse, or vouch for the individual ads that appear, and I am not responsible for the products, services, or content of any advertiser. Ad availability depends on Google's ad network and on your connection; if no ad is available, a reward that requires one may be temporarily unavailable.
5. No purchases
The App has no in-app purchases, no subscriptions, and no paid tier. Nothing in the App charges you money.
6. Your scores
The App keeps your best score for each subject on the device, plus a counter of how many times it has been launched, which is used only to decide when to ask you to rate it — see the Privacy Policy. Scores are not backed up anywhere. Deleting the App or resetting your device removes them, and I cannot recover them for you, because I have no copy of them.
7. Intellectual property
The App, its source code, design, icons, question banks, and other assets are owned by me or licensed to me, and are protected by copyright and other laws. Nothing in these Terms transfers any intellectual property to you. The name "ЗНО арена", the app icon, and associated marks may not be used without prior written permission.
8. No warranty
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. I do not warrant that the App will be uninterrupted or error-free, that the question banks are complete or accurate, or that using the App will improve any examination result.
9. Limitation of liability
To the fullest extent permitted by law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or examination outcome, arising out of your use of or inability to use the App, even if advised of the possibility of such damages. Because the App is free of charge, my total liability under these Terms is limited to the fullest extent permitted by applicable law.
Some jurisdictions do not allow certain limitations of liability or exclusions of implied warranties; in those jurisdictions, the above applies only to the extent permitted, and nothing in these Terms limits any rights you have as a consumer that cannot be waived.
10. Termination
This license terminates automatically if you breach these Terms, and you may end it at any time by deleting the App. Sections 6 through 11 survive termination.
11. Apple App Store terms, changes, and contact
The App is distributed through the Apple App Store. Apple's Standard Licensed Application End User License Agreement applies together with the applicable App Store terms. You acknowledge that:
- These Terms are between you and me, not between you and Apple; Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- Where these Terms conflict with Apple's terms, Apple's terms govern with respect to App Store usage.
These Terms may be updated from time to time. The "Last updated" date at the top of this page reflects the current version, and continued use of the App after a change constitutes acceptance of it. These Terms are governed by applicable law without regard to conflict-of-law provisions, without prejudice to any mandatory consumer protections available to you in your country of residence.
